MAGNETIC WORLD MUSIC FESTIVAL (THE “FESTIVAL”)
TERMS & CONDITIONS
1. Contract and Incorporation of Terms and Conditions
- 1.1
The ticket holder’s (“you”, “your”) contract for the purchase of ticket(s)is formed as soon as Magnetic World Music Festival Inc. (“we”, “us”)have processed your payment and will expire immediately after the end of the Festival. Purchases are subject to payment card verification and other security checks. Your transaction may be cancelled if it has not passed our verification process.

Your purchase ofticket(s) is subject to these Terms and Conditions, which incorporate and should be read in conjunction with any applicable venue and event partner(s)’terms, conditions and regulations.
- 1.3
You voluntarily assume all risks and danger incidental to the Festival for which the ticket isissued, whether occurring prior, during or after the Festival. You voluntarily agree that we, the management, venue, Festival participants and all respective agents, officers, directors, owners and employers are expressly released by youfrom any claims arising from such causes.
2. Tickets
- 2.1
All tickets are sold subject to availability and to these Terms and Conditions. These Terms and Conditions should be read carefully prior to purchase and any queries relating to them should be raised with us prior to purchase, as purchase of ticket(s)constitutes agreement with these Terms and Conditions. A valid ticket must be produced to get into the Festival. Please notify us of any access requirements at the time of booking. Removing any part of, altering or defacing the ticket may invalidate your ticket.

An order forticket(s) is not complete until it is accepted by us. We try to ensure all information and prices are correct but errors may occur. In the case of an error with your order, we will contact you as soon as possible.

- 2.4
We are not responsible for, and we do not guarantee the validity of, any ticket purchased from an unaffiliated third party.
- 2.5
We will not be responsible for, and no exchange, refund or replacement will be provided inrespect of any ticket that is lost, damaged, stolen, destroyed or unused.
- 2.6
Duplicating,removing or tampering with a ticket’s bar code will render such ticket invalid.
- 2.7
Possession of a ticket does not confer any rights (by implication or otherwise) on you to use,alter, copy or otherwise deal with any of the symbols, trade marks, logos and/or intellectual property appearing on the ticket.
- 2.8
No ticket may be used for advertising, promotions, contests or sweepstakes, unless prior written permission is given by us, provided that even if such consent is obtained, use of our trade marks and other intellectual property is not compromised.
- 2.9
Tickets sold are subject to our right to alter or vary the Festival lineup, schedule, and programming without being obliged to refund monies or exchange tickets.
3. Cancelled/Re-Scheduled Events
- 3.1
Occasionally,live performers have to cancel or postpone their performance for a variety of reasons. These events are outside of our control. If a performer cancels their appearance, then we will make best efforts to provide an alternative performer for the show. Your ticket will remain valid, and no refunds will be permitted.
- 3.2
Occasionally, for reasons outside of our control, venues may be forced to close or reduce their capacity. In the event of this occurring, we reserve the right to alter the structure of the Festival, or to move the Festival to another suitable venue within the surrounding area. Your ticket will remain valid, and no refunds willbe permitted.
- 3.3
Occasionally, for reasons outside of our control, the government may impose restrictions which result in public attendance at entertainment venues being prohibited. These events are outside of our control and no refunds will be permitted.
- 3.4
It is your responsibility to ascertain whether the Festival has been cancelled orre-scheduled and the date and time of any re-scheduled event. If the Festivalis cancelled or re-scheduled, we will use our reasonable best efforts to notify you using the contact details you provided us at the time of ordering. We do not guarantee that you will be informed of such cancellation before the date of the Festival.
- 3.5
For the purposes of these Terms and Conditions, “Force Majeure” means any cause beyond our control including, without limitation, an act of God, war, insurrection,riot, civil disturbances, acts of terrorism, fire, explosion, flood, theft ofessential equipment, malicious damage, strike, lock-out, weather, third party injunction, national defence requirements, acts or regulations of national or local governments, pandemic, and restrictions of fan attendance at live events or public screenings. We will not be liable to you for failure to perform any obligation under these Terms and Conditions to the extent that the failure iscaused by Force Majeure.
4. Refunds/Exchanges
- 4.1
Except as explicitly provided for here in, tickets cannot be exchanged or refunded after purchase.
- 4.2
Where an outdoor event is postponed, cancelled or curtailed because of adverse weather, we shall not be liable to make any refund or pay any compensation.
- 4.3
If you are unable to attend by reason of illness, change of circumstances or any other reason, we will not be liable to refund the ticket purchase.
5. Liability
- 5.1
Personal arrangements including travel, accommodation or hospitality relating to the Festival which have been arranged by you are at your own risk. Unless otherwise stated here in,our liability to you in connection with the Festival (including, but notlimited to, in the event of cancellation, rescheduling or material change tothe Festival lineup, schedule or programming) shall be limited to the ticket price paid by you.
- 5.2
Neither us, nor the venue, nor the event partner(s) accept responsibility for any lost, damaged or stolen personal property.
- 5.3
Neither us, nor the venue, nor the event partner(s) will be responsible for any loss, injury or damage to any person (including you) or property, how so ever caused.
6. Conditions of Admission and Attendance
- 6.1
We reserve the right to refuse admission and may on occasion have to conduct security searches to ensure the safety of our customers. Even if you have a ticket, there may be circumstances where we feel or understand, in our sole discretion, that you should not be permitted at the Festival, such as you being drunk, under the influence of illegal substances or otherwise excessively intoxicated. In such circumstances you will not be permitted to enter the Festival and no refund will be given.
- 6.2
Every effort to admit late comers will be made at a suitable break in the Festival, but late admission cannot be guaranteed.
- 6.3
Illegal, antisocial, dangerous or otherwise unsatisfactory behaviour (towards yourself or other Festival attendees) will not be tolerated and will lead to ejection from the Festival without a refund.
- 6.4
We and/or the management of the venue reserve the right to refuse ticket holders’ admission to the venue in reasonable circumstances, including for health and safety,licensing reasons or where a ticket is void.
- 6.5
We and/or the management of the venue reserve the right to request that ticket holders leave the venue at any point on reasonable grounds and may take appropriate action to enforce this right.
- 6.6
You must comply with instructions and directions given by our staff, venue staff and event partner staff.
- 6.7
No refunds will be given to ticket holders who are refused entry or ejected due to their own behaviour.
7. Restrictionsand Prohibitions
- 7.1
The use of photographs, videos, and any other audio, visual or audio-visual material taken, recorded or otherwise captured inside the Festival venue for any use other than personal use is prohibited without obtaining our prior written consent.
- 7.2
The use of the phrase “Magnetic World Music Festival” and all other symbols, trade marks,logos and/or intellectual property associated with the Festival in the title of any publication or advertisement is prohibited without obtaining our prior written consent.
- 7.3

- 7.4
The following are strictly prohibited at the Festival:
Fireworks, flares smoke bombs or any other type of pyrotechnic;
Your own food and drink;
Your own food and drink; and
- 7.5
We and/or the management of the venue reserve the right to conduct security searches from time to time and confiscate any item which, in the reasonable opinion of the management of the venue, may cause danger or disruption to other members of the audience or the Festival or is one of the above-listed items not permitted in the venue.
- 7.6
Ticket holders may only leave and re-enter the venue during the Festival at our discretion.There will not otherwise be any re-admission or pass-outs of any kind.
8. Sale of Alcohol
- 8.1
Sales of alcohol are made subject to the applicable liquor licensing legislation and regulations in the province of Nova Scotia and in accordance with the terms of the venue.
- 8.2
We reserve the right to refuse any sale of alcohol.
9. Health and Safety
- 9.1
Ticket holders must comply with all relevant statutes, safety announcements and venueregulations whilst attending the Festival. If ticket holders have any special requirements or concerns about any special effects which may be featured at the Festival, prior notice should be provided to us when ordering tickets. Special effects may include, without limitation, sound, audio-visual, pyrotechnic effects or lighting effects.
10. Waiver
- 10.1
If we delay or fail to enforce any of these Terms and Conditions, it shall not mean that we have waived our right to do so.
11. Severability
- 11.1
If it is found byany court of competent jurisdiction that any of these Terms and Conditions for any reason cannot be enforced, this shall not prevent the remaining provisions from continuing to apply.
11. Governing Law and Jurisdiction
- 12.1
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Province of Nova Scotia and the laws of Canada applicable therein.
- 12.2
The parties irrevocably agree that the courts of Nova Scotia, Canada shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with these Terms and Conditions or their subject matter or formation (including non-contractual disputes or claims).
